5.2 These Terms

These Terms and Conditions ('Terms') govern your use of www.myfunkygolf.com and any purchase you make from us. By placing an order, you confirm you have read and agree to these Terms. Please read them carefully before ordering.

5.3 Eligibility

You must be at least 18 years old to purchase from our store. By placing an order you confirm you meet this requirement.

5.4 Products and Descriptions

We take reasonable care to ensure product descriptions, images and prices are accurate. However, minor variations in colour may occur due to screen settings. We reserve the right to correct errors in product listings at any time.

5.5 Pricing and Currency

All prices are displayed in your selected currency (EUR, GBP or SEK). Prices include VAT where applicable. We reserve the right to change prices at any time. The price you pay is confirmed at checkout before you complete your order.

5.6 Promotions and Discount Codes

Promotional codes are subject to their own terms. They cannot be combined with other offers unless stated. We reserve the right to withdraw promotions at any time.

5.7 Order Process and Contract Formation

Placing an order constitutes an offer to purchase. A contract is formed when we send you an order confirmation email. We reserve the right to refuse or cancel any order, including where: a product is out of stock, there is an error in pricing or description, we suspect fraudulent activity, or payment is declined.

5.8 Payment

5.9 Stock Availability

We aim to keep stock levels accurate. If a product becomes unavailable after your order is placed, we will contact you promptly to offer an alternative, a delay or a full refund.

5.10 Delivery

Orders are fulfilled within 48 hours of payment confirmation (excluding weekends and public holidays). Estimated delivery times vary by destination and are typically 4–10 working days from dispatch. 5.11 Risk and Ownership

Risk in the goods passes to you on delivery. Ownership passes to you once full payment is received.

5.12 Consumer Rights

If you are a consumer in the UK or EU, your statutory rights are not affected by these Terms. EU consumers have a statutory 14-day withdrawal right for distance contracts — see Section 8 for details.

5.13 Warranties and Defective Goods

We warrant that our products conform to their description and are of satisfactory quality. If goods are defective on arrival, contact us within 30 days for a replacement or full refund. Your statutory rights are unaffected.

5.14 Intellectual Property

All content on www.myfunkygolf.com, including images, text, logos, designs and product photography, is owned by or licensed to Smart Solutions Europe Ltd. You may not reproduce, distribute or use any content without our prior written consent.

5.15 Limitation of Liability

To the fullest extent permitted by law, Smart Solutions Europe Ltd's liability for any claim arising from your use of the store or a product purchase is limited to the price you paid for the relevant product. We are not liable for indirect, incidental or consequential losses. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or any other matter where limitation is prohibited by law.

5.16 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, industrial disputes, carrier failures or government actions.

5.17 Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer law in your country applies.
